GENERAL TERMS AND CONDITIONS – MULTI-DAY TOURS

These General Terms and Conditions regulate the relationship between Adriatic Kayak Tours ltd. (hereinafter: "the Organizer") and the client (hereinafter: "the Traveler") booking a multi-day tour package organized by the company, in accordance with the Act on the Provision of Tourism Services (OG 130/17, 25/19, 42/20, 70/21), the Civil Obligations Act, and applicable consumer protection laws.


  • 1. BOOKING AND CONTRACT FORMATION

  • A booking becomes binding when the Company receives a written confirmation from the Traveler (via email or booking form) and payment of a deposit.

    The person making the booking confirms that they have the authority to accept these Terms on behalf of all persons included in the booking. The contract is concluded between the Company and the Traveler upon confirmation.

     


  • 2. TOUR PACKAGE PRICE – INCLUDED SERVICES
  • Tour prices include:
  • Accommodation (double occupancy; single supplement available for a fee),
  • Meals as specified in the itinerary (excluding drinks unless otherwise noted),
  • Airport transfers (on the tour's start and end dates),
  • Transfers by car and ferry as indicated,
  • Use of kayak, bike, and snorkeling equipment:
  • Kayaks: single and tandem sit-in touring kayaks with rudder or skeg, paddle, sprayskirt, life vest, and dry bags,
  • Paddle jackets and waterproof pants provided in shoulder seasons,
  • Snorkeling: mask, snorkel,
  • Cycling: Specialized gravel bicycles, helmet.
  • Tour guide services and basic instruction,
  • Applicable VAT and taxes,
  • Company and professional liability insurance.

  • 3. NOT INCLUDED IN THE PRICE
  • Tour package does not include:
  • International or domestic airfare,
  • Beverages (alcoholic or soft drinks, coffee/tea outside breakfast),
  • Travel insurance (cancellation, accident, health, or baggage coverage),
  • Optional activities,
  • Personal expenses (e.g. phone, internet, laundry),
  • Tips and gratuities.

  • 4. CUSTOM SERVICES Adriatic Kayak Tours Ltd. is a fully licensed travel agency and tour operator, offering assistance with custom arrangements including additional accommodation, transfers, and private tours for an extra fee. Contact us for details.


  • 5. BOOKING & PAYMENT TERMS
    Prices are listed in Euros (EUR).
    A deposit of 20% is required to confirm multi-day tour bookings and must be received within 21 days of the reservation. 
    Final payment is due 7 days prior to the tour start date (Multi-day tours).
    A deposit of 20%  is required to confirm day tours reservations.
    Payment is accepted by credit card or bank transfer.
    All online payments are securely processed through Monri WSPay, in accordance with PCI DSS standards using SSL encryption and TLS 1.2 protocol.
    Minor currency conversion differences may occur based on your card provider’s rates.


  • 6. CANCELLATION POLICY  Cancellation fees are calculated as a percentage of the total price of the travel package. The Traveler may cancel* their tour at any time prior to the start date. In such cases, the following cancellation fees** apply:

  • More than 60 days before the tour: full refund (0% cancellation fee)

  • 59 to 30 days before the tour: 50% cancellation fee

  • 29 to 15 days before the tour: 70% cancellation fee

  • 14 to 7 days before the tour: 80% cancellation fee

  • Less than 7 days before the tour / No-show: 100% cancellation fee

  • *The date of cancellation is the date on which the Organizer receives written notice of cancellation.
  • **excluding non-refundable third-party processing and transaction fees (e.g. payment gateway or bank charges)

  • Considering that the contract is concluded at a distance (via the internet) and in accordance with applicable legal provisions, the Traveler has the right to withdraw from the package travel contract within 14 days of its conclusion, without providing any reason.

  • The Traveler may transfer their booking to another person up to 7 days before the tour, provided the replacement meets all participation requirements. Administrative fees apply.

  • The traveler has the right to terminate the package travel contract before the start of the package without paying any termination fee in the event of unavoidable and extraordinary circumstances occurring at the destination or in its immediate vicinity, which significantly affect the performance of the package or which significantly affect the transport of passengers to the destination. 

  • We recommend purchasing cancellation insurance.


  • 7. CHANGES BY THE ORGANIZER The Organizer reserves the right to make changes to the itinerary due to weather, sea conditions, or force majeure. Any modifications will aim to preserve the overall content and quality of the program. In the event of significant changes, Travelers will be notified as early as possible.


  • 8. TRAVELER’S OBLIGATIONS Travelers must possess valid travel documents and comply with local laws and regulations. They are responsible for assessing their own fitness and health condition for participation in physical activities such as kayaking, biking, and hiking.


  • 9. LIABILITY & INSURANCE The Organizer is not responsible for injury, illness, loss, or damage incurred during the trip unless resulting from gross negligence.  Participation in certain activities involves inherent risks which are accepted by the Traveler. 

  • We recommend that Travelers obtain travel health and accident insurance with relevant inclusions (activities listed in the tour package).


  • 10. DATA PROTECTION We process personal data in accordance with the General Data Protection Regulation (GDPR). Personal data is collected only as necessary for service provision and legal compliance. Access is limited to authorized staff. Third parties (e.g., payment processors) are contractually bound to safeguard data.

  • Traveler Information we collect

  • The Traveler is required to provide accurate and complete personal information necessary for the organization and execution of the travel package.

  • This includes:

  • * Full name (as stated in travel documents)
  • * Contact details (email and phone number)
  • * Residential address
  • * Nationality
  • * Date of birth (if required for specific services)
  • any relevant health conditions, dietary requirements, or special requests
  •  
  • Failure to provide required information may result in the inability of the Company to deliver the contracted services, for which the Company shall not be held responsible.


  • 11. COMPLAINTS & JURISDICTION Complaints must be submitted in writing no later than 8 days after the tour ends. If a resolution is not reached, jurisdiction is with the competent court in Zagreb, Croatia.


  • 12. FINAL PROVISIONS These Terms and Conditions form an integral part of the contract between the Organizer and the Traveler. By confirming the booking, the Traveler acknowledges acceptance of these Terms and Conditions.

We take data protection and privacy very seriously. We collect only relevant and necessary data to accomplish the specified purpose and to meet our obligations. Our buyers are informed about the way the collected data is used, moreover, they can control and determine how their personal data is used. Buyers can also decide whether they want their name removed from the list used for marketing campaigns.

All user personal data is kept strictly confidential. It is available only to employees who require such data to perform their work tasks. All employees of Jadranske kajak ture d.o.o. and business partners are obliged to demonstrate that their activities are compliant with the Data Protection Principles.
